Kinney vs. Marcus
Pt. 2
And so it was that for the second time is less than 24hrs Brian, Justin, and Tony took a seat across the desk from Kenneth Davenport. The three men listened attentively as Tony's lawyer explained his most recent findings. "Children aren't used cars." he began. "One can't just give them away, or sell them off at lib. First a home study would have to be done to make sure that the adoptive home is safe, and in the best interest of the child. Then there's the waiting period in the event that one, or both parents would change their minds. Now I know what you're thinking. It's been over five years. That's far beyond the statutory waiting period for an adoption to be finalized. You're right. That's why my first course of action was to check the datelines to make sure that Brian was given ample time to renege on the agreement. That's when I discovered that there was no record of a home study having been done, AND no papers petitioning the court for Gus's adoption was ever filed."
Brian, Justin, and Tony sat momentarily at a loss for words.
"So what exactly are you saying?" Brian broke the silence. He needed to make sure that he was understanding what Kenneth was saying.
"I'm telling you that Gus is now, and has always been your son Brian. Melanie has no legal ties to Gus. We're ready to go to court, and demand your visitation from Lindsey." Kenneth said.
"Visitation? You must be out of your fucking mind. We want more than just visitation. We want this bitch Melanie to pay for what she's done. I want her license to practice law brought to me on a silver platter!" Tony demanded.
"Tony wait." Justin reached over, and grabbed Tony's arm. "Mr. Davenport I can't believe that Mel would do this to Gus or Lindsey."
"Maybe Lindsey was in on the deception." Kenneth speculated.
"Sue them both!" Tony interjected.
"That doesn't make sense. Why would they do that?" Justin couldn't understand.
"It's pretty simple when you think about it. It all boils down to money." Kenneth attempted to explain. "By secretly allowing Brian to remain Gus's legal father Melanie, and Lindsey get the best of both worlds. As long as they remain a couple they have full legal rights to Gus. If they ever decide to break up, Melanie is off the hook for child support, Lindsey won't have to worry about her girlfriend fighting for joint custody, and Brian being Gus's legal father is obligated to support his kid."
"No, Lindsey wouldn't do that." Brian said.
"I've been practicing law for a long time Brian. I've seen it all. You'd be surprised what people will do for money." Kenneth said.
"I say we nail both of these cunts for extortion, fraud, mental anguish, KIDNAPPING! ."
"Take it easy Tony." Justin said.
"DON'T TELL ME TO TAKE IT EASY!" Tony bellowed. "I want those dykes sued for everything they've got! Do you hear me Kenneth? I want them broke, homeless, and living on the goddamn streets! I don't give a shit if they have to set up a tent in front of the steel mills, and give tag-team blowjobs to fat, sweaty hetero fucks on their lunch break to survive ."
After nearly seven years of being Tony's lead counsel, Kenneth Davenport was use to his bosses' tirades. Amidst Tony's fury the consummate lawyer quietly turned to Brian. "The ball is in your court now Brian. What do you want me to do?" he asked.
"I don't know. I need some time to think." Brian said.

With Kenneth Davenport hot on her heels, Melanie was frantic to get the petition for Gus's adoption on file before Tony's Michigan Avenue lawyer subpoenaed those records. "Ellen, reschedule my afternoon appointments for me. I'm going to be out of the office for the rest of the day." She notified the front desk.
"Ms. Marcus there's a Mr. Brian Kinney here to see you. He insists that it's urgent." Ellen informed her.
"Get rid of him! Tell him I'm on my way out!" Melanie called back to Ellen, then picked up her briefcase, and headed for the door. With Brian now at the front receptionist desk, the rear exit overlooking the associates parking lot had become Melanie's new route of escape. She was about to leave when a commotion coming from the other end of the hall stopped her.
"Mr. Kinney, I've told you that Ms. Marcus can't see you now. Please leave before I call the police!" Ellen's voice rang out.
Brian soldiered past the frightened receptionist, and made his way down the long hallway, past the offices of Kurtzman, Vasquez, and Kushira until he came upon the door with Melanie's name stenciled onto the frosted glass window pane. Brian placed his hand firmly on the brass doorknob, and pushed his way inside to find Mel standing in the middle of the floor, with her briefcase still in her hand. "I'm glad I was able to catch you Ms. Marcus." he said.
Kurtzman, Vasquez, and Kushira dashed out of the offices, and followed the intruder "Sir, get out! The police have already been called!" They came to their associate's defense.
Brian ignored their warnings. Instead he strolled past Melanie, took a seat in the chair across from her desk, then leaned back, and casually crossed his legs. Brian had already elected that he might as well get comfortable. There was no way that he was leaving Mel's office until she had given him satisfactory explanation that would justify the feud she, and Lindsey had perpetrated against him.
"It's ok guys. Please call the police back, and tell them not to come. I'll see Mr. Kinney now." Melanie said, as she sat her briefcase down. The cornered lawyer waited for her office to clear before rounding her desk to her seat, and confronting her biggest fear. "You know don't you?" Melanie finally said.
"Yes, I know." Brian conceded. "But I need you to tell me why."
Melanie took a deep breath, and began. "Lindsey, and I were already having problems when we decided to get pregnant. I guess after awhile you just run out of things to say. Couples grow apart. We thought that perhaps a baby would bring us back closer together, and make us a real family. Of course I had my doubts, but I was willing to try."
"And?" Brian said.
Melanie swallowed hard, and took another deep breath. "I had an affair while Lindsey was pregnant." she confessed.
"Anyone I know?" Brian asked.
"No, but it's someone that Lindsey knows. Her name is Marianne. She's the same woman I had the affair with, and Lindsey found out about it after Gus was born. Actually she's the same woman that I've never stopped seeing." Melanie begrudgingly admitted.
"Wait a minute, let me see if I've got this right." Brian wanted to make sure that he was understanding correctly. "You cheated on Lindsey with this Marianne person throughout Lindsey's pregnancy, AND after Gus was born, AND you're still seeing her now?"
"I promised Marianne that I was going to leave Lindsey once the baby was born. I didn't tell Lindsey, and I didn't file Gus's adoption papers because I wanted it to be a smooth exit." Melanie said.
"So what happened? What made you stay?" Brian asked.
"The same thing that always happens when you become involved, and one, or both parties are already in a relationship. Marianne decided to stay with her partner." Melanie said.
"And you decided that you might as well stay with Lindsey. Does Lindsey know that she's a consolation prize?" Brian was beginning to loose his temper. "Was my son a consolation prize for you too?"
"No, it's nothing like that Brian. I love Lindsey, and I love Gus." Melanie insisted. "I just didn't realize how much I loved them, and needed them until Jenny Rebecca died. Now do you see why I can't let Lindsey find out that the adoption papers were never filed? Lindsey may have forgiven me before, but she'll never forgive me this time for continuing to carry on an affair with the same woman, and plotting to abandon her, and Gus."
Brian stood up, and began to pace the floor. "This is fucked up. This is so fucked up!" he said.
"Brian, please don't tell Lindsey!" Melanie pleaded.
"How can I not tell her? Lindsey's my friend, and the mother of my kid." Brian reminded her. "What the hell am I suppose to do, just sit back, and watch her get fucked over by her whorish ass girlfriend?"
"Lindsey is my wife." Melanie corrected him.
"THAT'S WORST!" Brian said. "Goddamn you Mel! Do you know what kind of position you've put me in? Lindsey will hate me forever if she finds out that I knew about this betrayal."
"She doesn't have to ever know!" Melanie said.
"BULL-SHIT! These kind of lies always have a way of surfacing. ALWAYS!" Brian said with most certainty.
"Brian please, I'm begging you. I'll give you anything you want, but don't take my family away from me. Lindsey, and Gus are all I have. Please Brian." Melanie began to weep.

Back at penthouse four of The Plaza Hotel Justin had his hands full. Tony was still in full attack mode, poised to take down Melanie, and Lindsey for what they had done to Brian. Justin's incensed lover flung his suit jacket across the sofa. "Brian needs time to think. What the hell is there to think about? You heard what Ken said, we're ready to go to court!" Tony fussed.
"It's not our decision Tony. This is between Brian, and his lesbians." Justin reminded him.
"Women." Tony grumbled, and lumbered over to the bar. "Do you want a drink princess?"
"I'll take an Evian." Justin said.
Tony dropped three cubes of ice into two tall glasses, and twisted the caps off of the bottled water. "How the hell did Brian get mixed up in this shit anyway? One of the greatest perks of being gay is that boys don't get pregnant. Hence we don't have to deal with any of that silly baby-mama-drama." Tony continued to fuss.
"Brian, and Lindsey have been friends since forever, so when Lindsey decided to have a baby she chose Brian to be the father." Justin explained.
Tony stopped pouring, and looked over at Justin. "You mean Brian actually fucked her?" he grimaced. "I thought it was one of those turkey baster kind of things that lesbians do."
"Gus was one of those turkey baster deals, but Lindsey, and Brian did date for a while when they were in college." Justin said.
"Christ." Tony took a sip from his glass, and walked the other drink over to Justin. "Once you fuck a woman you can never get rid of her." he said.
Justin took a sip of his Evian. "Tell me about it." he agreed. "I fucked my friend Daphne once, and she got all weird on me. She started acting like we were boyfriend, and girlfriend even though she knew I was in love with Brian. How about you Tony, have you ever had sex with a woman?"
"Yes I have on more occasions than I care to remember, thank you very much." Tony took another sip.
"So what did you think of it?" Justin pressed the issue.
Tony thought for a moment. "It was ok I guess, just way too wet for my taste." he said.
"Wet?" Justin began to laugh.
"Yeah. It was like somebody opened the flood gates. There wasn't any resistance at all. I just kind of fell in." Tony recalled, much to Justin's continued amusement. "Could we please change the subject princess?"
"I'll bet you were a real ladies man." Justin tried to catch his breath.
"I did alright, but my heart wasn't in it. I've always preferred hot little blonde boys with smooth, round asses, and tight little puckered holes." Tony purred.
"You mean like this?" Justin turned around, and ran his hands down along the back of his pants.
"Yeah, exactly like that." Tony smiled. "Pull them down for me princess, and let me see."
Justin unzipped his pants, and slowly slid them down over his ass, suggestively bending at the waist to allow his lover a full, glorious view .
"Well, it looks like I'm just in time!" Brian walked through the door. "Do go on. Please don't stop on my account." Brian grinned.
Justin quickly pulled up his pants. "How are you? Did you get everything sorted out?" he asked.
"As a matter of fact I did." Brian said as he walked over to the bar to pour himself a drink. "I spoke to Melanie, and she's agreed to allow me liberal visitation with Gus, including every other weekend. Kenneth, and Mel are working out the details as we speak."
"That's great Brian!" Justin smiled.
"Allow YOU visitation? Did you remind Ms Marcus that she doesn't have any legal ties to Gus. And what about the fraud? I know you're not going to let her get away with that, are you?" Tony was getting fired up once again.
Brian downed his drink, and walked over to where Tony was standing. He placed his arms around his man, then beckoned for his baby to come and join them. "Thank you." Brian hugged, and kissed them both. "Thank you for being here for me."
"That's what family is for." Tony said.
"That's right." Justin agreed.
